1. General Provisions

1.1. These Terms of Service define the type, scope, and conditions of provision of electronic services through the roomstaging.net website, including the rules for using the AI-powered virtual home staging Platform.

1.2. The owner of the Website is Roman Deiniuk. Contact: [email protected].

1.3. Use of the Website and Services provided through it requires prior acknowledgment and acceptance of these Terms of Service. Failure to accept these Terms prevents use of the Services.

1.4. These Terms are directed to Entrepreneurs using the Services for purposes directly related to their business or professional activity. Due to the nature of the Services, these Terms do not apply to Consumers.

2. Definitions

Account / Customer Account – a part of the Website constituting a set of resources and rights assigned to a particular Customer, accessible after logging in with a login and password, through which the Customer has access to the Platform and may use the Services.

Consumer – a natural person who makes a legal transaction with an entrepreneur that is not related directly to his/her economic or professional activity, as well as an entrepreneur running a sole proprietorship, entering into contracts of a non-professional nature, who is granted a consumer nature rights under the provisions of law (including the Act on Consumer Rights and the Civil Code).

Customer – an Entrepreneur using the Services under the Agreement for purposes directly related to their business or professional activity, particularly real estate agents, real estate photographers, and property managers.

Entrepreneur – a natural person who is not a Consumer, a legal person, or an organizational unit that is not a legal person but to which separate legislation grants legal capacity, conducting business activity.

GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data.

Image Limit – the maximum number of transformations (image processing operations) that the Customer can perform within the purchased Subscription Plan during a given Settlement Period.

Input Image – a photograph of a room uploaded by the Customer to the Platform for the purpose of performing a Transformation.

Output Image – an image generated by the Platform based on the Input Image with the application of the Transformation selected by the Customer.

Platform – an IT solution available in the SaaS (Software as a Service) model using artificial intelligence technology for automatic virtual staging, furniture removal, and room renovation based on uploaded photos.

Price List – a list of information about the prices of Services provided by the Service Provider, available on the Website at https://roomstaging.net/pricing, constituting an integral part of these Terms.

Services – free and paid services provided electronically through the Website by the Service Provider to the Customer, consisting of: (a) virtual furnishing of empty rooms, (b) removing existing furniture, (c) virtual renovation and style changes to rooms.

Service Provider – the entity providing Services electronically based on these Terms, i.e., roomstaging.net.

Settlement Period – the period for which the Customer's obligations under Services provided on a subscription basis are settled, being 30 days (monthly plan) or 365 days (annual plan) respectively.

Subscription Fee – a fee paid by the Customer in the amount specified in the Price List for the use of Services in a given Settlement Period.

Subscription Plan / Plan – the variant of Services selected by the Customer, defining the monthly Image Limit and Subscription Fee (e.g., Basic, Standard, Professional, Enterprise).

Terms of Service / Terms – these terms of service for electronic services constituting a standard form agreement.

Transformation – a single operation of processing an Input Image by the Platform to generate an Output Image. Each Transformation reduces the available Image Limit by 1.

Website – an organized IT and information platform enabling the Customer to use the Services, available at roomstaging.net and its subdomain addresses.

3. Technical Requirements

3.1. Using the Website requires meeting the following minimum technical requirements:

  • a device with Internet access (computer, tablet, smartphone),
  • Internet connection with a minimum bandwidth of 5 Mbps,
  • web browser: Google Chrome (version 90+), Mozilla Firefox (version 88+), Safari (version 14+), Microsoft Edge (version 90+),
  • JavaScript and cookies enabled,
  • active email address.

3.2. Recommended Input Image formats: JPG, PNG. Maximum file size: 10 MB. Recommended resolution: minimum 1024x768 pixels for best results.

4. Customer Account

4.1. Registration and maintenance of the Customer Account are free of charge.

4.2. Creating an Account requires providing the following information: first and last name (optional), email address, company name (optional).

4.3. The Account agreement is concluded upon registration and activation of the Account. Alternatively, an Account may be created by logging in through social media accounts (Google, Facebook, Apple).

4.4. The Customer undertakes to maintain the confidentiality of Account access data. To maintain the security of login, the Service Provider recommends changing the login password every 30 days. The Service Provider is not responsible for consequences of disclosing login credentials to third parties.

4.5. The Customer may delete their Account at any time through the option available in Account settings or by sending a request to [email protected].

4.6. The Service Provider reserves the right to block or delete an Account in case of violation of these Terms or suspicion of fraudulent activity.

4.7. Change or recovery of the password is possible through the password recovery or change function available at Account Settings.

5. Types of Services and Subscription Plans

5.1. Types of Services:

  • Home Staging – automatic addition of furniture and decorations to empty rooms,
  • Furniture Removal – removal of existing furniture from rooms,
  • Renovation – virtual changes to style, colors, and finishes of rooms.

5.2. Each Transformation (regardless of the type of Service) reduces the available Image Limit by 1.

5.3. Services are available through:

  • Free trial plan – limited number of Transformations available one-time after registration,
  • Monthly Subscription Plans – renewable every 30 days,
  • Annual Subscription Plans – renewable every 365 days.

5.4. The Image Limit in monthly plans is available for 30 days from the start date of the Settlement Period. Unused limit expires at the end of the Settlement Period.

5.5. The Image Limit in annual plans is divided into equal monthly portions and made available automatically at the beginning of each month within the paid annual Settlement Period. Unused monthly limit expires 30 days after it is granted.

5.6. Output Images generated under the free trial plan are marked with a watermark. The watermark is removed upon purchase of any paid Subscription Plan.

5.7. Detailed information about available Subscription Plans, Image Limits, and prices can be found in the Price List.

6. Ordering and Payment

6.1. Orders for Services are placed by selecting a Subscription Plan on the Website and making payment.

6.2. The agreement for paid Services is concluded upon payment confirmation by the Stripe payment system.

6.3. Payments are processed by Stripe. Available payment methods: credit cards (Visa, Mastercard, American Express), BLIK, bank transfers, Google Pay, Apple Pay.

6.4. Access to Services within the purchased Subscription Plan will be activated immediately upon payment confirmation.

6.5. Subscription Plans automatically renew at the end of each Settlement Period unless the Customer cancels renewal with at least 24 hours notice before the end of the period.

6.6. Invoices are issued automatically and sent to the email address provided during registration within 7 days of payment.

6.7. The Customer agrees to receive invoices from the Service Provider electronically, in accordance with Article 106 n (1) of the Act of 11 March 2004 on value-added tax.

6.8. Any changes to the Subscription Fees shall be published on the Website through the announcement of the current Price List.

7. Intellectual Property Rights

7.1. The Customer represents and warrants that they possess all necessary rights to Input Images uploaded to the Platform, including copyrights or appropriate licenses.

7.2. For photos containing images of people, the Customer is obligated to obtain consent from those individuals for processing their image.

7.3. The Service Provider is not responsible for copyright or image rights violations resulting from the Customer uploading photos to which they do not have appropriate rights.

7.4. Upon payment for the Service and generation of the Output Image, the Customer acquires a non-exclusive, territorially unlimited license to use the Output Image for commercial and non-commercial purposes.

7.5. The Service Provider reserves the right to use Input and Output Images for purposes of:

  • improving and developing the AI-powered Platform,
  • presentation in portfolio and marketing materials (unless the Customer objects),
  • training AI models to improve Service quality.

7.6. All elements of the Website and Platform, including source code, interface, logos, and AI models, constitute the Service Provider's intellectual property and are protected by copyright law.

8. Restrictions and Prohibitions

8.1. It is prohibited to upload images of the following nature:

  • pornographic or containing erotic content,
  • promoting violence, hatred, or discrimination,
  • violating third-party rights,
  • containing illegal or harmful content,
  • containing images of minors without legal guardian consent.

8.2. It is prohibited to:

  • interfere with Platform operation,
  • attempt to bypass technical security measures,
  • use bots or automated tools for mass image generation,
  • resell Platform access without Service Provider consent,
  • reverse engineer or decompile Platform code.

8.3. Violation of the above prohibitions may result in immediate Account blocking without refund.

9. Service Quality and Liability Limitations

9.1. The Platform uses advanced artificial intelligence algorithms; however, the Service Provider does not guarantee that every Output Image will fully meet the Customer's expectations.

9.2. The quality of Output Images depends on many factors, including Input Image quality, lighting, photo angle, and room characteristics.

9.3. The Customer may generate multiple variants of the same room to obtain the best result.

9.4. The Service Provider is not liable for:

  • incorrect results arising from low-quality Input Images,
  • erroneous furniture placement resulting from unusual room architecture,
  • improper use of Output Images by the Customer,
  • business decisions made based on Output Images,
  • indirect damages, including loss of profits, reputation, or customers.

9.5. The Service Provider's total liability for providing Services is limited to the amount of fees paid by the Customer in the last 12 months.

10. Refund and Complaint Policy

10.1. 7-Day Money-Back Guarantee:

10.2. The Customer has the right to a refund within 7 days of making their first paid Subscription Plan purchase, provided that:

  • it is the Customer's first subscription,
  • no more than 10 Transformations have been performed (or no more than 5 Transformations for the Basic Subscription Plan),
  • the refund request has been submitted to [email protected].

10.3. Refunds will be processed within 14 days to the same payment method used for purchase.

10.4. After the 7-day refund period expires, all fees are non-refundable, and subscription cancellation only results in no automatic renewal for the next Settlement Period.

10.5. Service quality complaints should be submitted to [email protected], including:

  • email address associated with the Account,
  • problem description,
  • attachment with Input and Output Image (if applicable).

10.6. Complaints are processed within 14 business days of receiving the submission.

11. Contract Termination

11.1. The Contract for the Services shall be terminated:

a) for the Service of maintaining the Customer Account – at the moment of submitting by the Customer an instruction to delete the Account (through the option available in Account settings or by sending a request to [email protected]) or as a consequence of deleting the Customer Account by the Service Provider due to termination of the Contract for the reasons specified in Section 11.4 hereof,

b) in respect of the Service provided free of charge (free plan) – upon exhaustion of the available Transformation limit or expiration of the free plan duration and in connection with non-purchase of a paid Subscription Plan,

c) in respect of the Service provided for a fee – upon expiry of the period for which the Subscription Plan was purchased and failure to continue the Contract for a further Settlement Period, which shall be understood as lack of automatic subscription renewal or failure to pay the Subscription Fee for the next Settlement Period.

11.2. The Customer may terminate the Contract without giving any reasons by:

a) canceling automatic subscription renewal in Account settings – in such case, the Contract expires at the end of the current Settlement Period and the fees previously charged are not refunded,

b) deleting the Customer Account – in such case, the Contract expires immediately; however, fees previously charged for unused period are not refunded, subject to Section 10.2 (refund policy).

11.3. In case of canceling automatic subscription renewal, the Customer retains access to Services and the remaining Image Limit until the end of the paid Settlement Period.

11.4. The Service Provider is entitled to terminate the Contract without notice (with immediate effect) in case of:

a) submission by the Customer of false and incomplete data which are necessary for the execution of the Contract,

b) reasonable suspicion or finding that the Customer uses the Services in a manner contrary to these Terms or in a way which violates generally applicable provisions of law,

c) use of Services in a manner violating third-party rights, including in particular violation by the Customer of obligations set out in Section 8 hereof (prohibitions and restrictions),

d) conducting activity constituting abuse of Services or fraud, including use of automated tools or bots,

e) failure to pay for Services.

11.5. In case of Contract termination by the Service Provider for reasons specified in Section 11.4, the Customer is not entitled to a refund of previously paid fees, and the Service Provider may block access to the Account with immediate effect.

11.6. Contract termination in any form does not release the Customer from the obligation to pay dues for the period during which Services were provided.

12. Personal Data Protection

12.1. The personal data controller for Customers is the Service Provider.

12.2. The Service Provider processes personal data in accordance with GDPR for the following purposes:

  • providing Services and managing Accounts,
  • processing payments and issuing invoices,
  • communicating with Customers,
  • improving the Platform and training AI models,
  • direct marketing (after obtaining consent).

12.3. Detailed information regarding personal data processing is contained in the Privacy Policy available at https://roomstaging.net/legal/privacy.

12.4. Images uploaded by Customers are stored on secure servers for the period necessary to provide Services and may be used for training AI models.

12.5. Customers have the right to request deletion of their data, subject to the Service Provider's legal obligations.

13. Technical Support

13.1. During the term of the Contract and as part of the Subscription Fee, the Customer may use the Service Provider's technical support in connection with the Services.

13.2. The technical support and assistance are provided by the Service Provider from Monday to Friday (except statutory holidays in the Republic of Poland) from 09:00 to do 17:00.

14. Final Provisions

14.1. These Terms are available free of charge on the Website at https://roomstaging.net/legal/terms.

14.2. The Service Provider reserves the right to make changes to these Terms. Customers will be informed of planned changes with 14 days notice via email and a notice on the Website.

14.3. Failure to object to changes within 14 days means their acceptance. In case of objection, the Agreement terminates on the day preceding the effective date of the new provisions.

14.4. For matters not regulated by these Terms, the following laws apply:

  • Act of 18 July 2002 on the provision of services by electronic means,
  • Civil Code,
  • GDPR and other generally applicable laws.

14.5. Any disputes arising from these Terms shall be resolved by the court with jurisdiction over the Service Provider's registered office.

14.6. These Terms are effective as of December 15, 2025.
